Article 1 — Identification of the provider

Signature Normandy Tours, a sole proprietorship (entreprise individuelle, EI) registered in France, offers tour-guiding, transport and bespoke sightseeing services throughout France. These Terms and Conditions of Sale (the "Terms") govern all contractual relations between Signature Normandy Tours, hereinafter referred to as "the Provider", and any client, whether an individual or a business, using its services.

Article 2 — Scope

These Terms apply to all services offered by Signature Normandy Tours, whether entered into with individuals (B2C) or businesses (B2B). Any order or booking implies full and unreserved acceptance of these Terms. These conditions prevail over any other document of the client, save for an express written waiver by the Provider.

Article 3 — Nature of the services

Signature Normandy Tours offers in particular the following services:

  • Bespoke guided tours, in French and English
  • Tourist transport with accompaniment
  • Tailor-made programmes for private groups and business clients
  • Combined transport and tour services

Each service is the subject of a personalised quotation, drawn up in agreement with the client. The signed quotation constitutes the purchase order.

Article 4 — Booking and confirmation

All bookings must be made in writing (by email or form). The booking is confirmed upon the client returning the signed quotation and, for business clients, upon payment of the deposit provided for in Article 5.

The Provider reserves the right to refuse any booking in the event of unavailability or incompatibility with its current commitments.

Article 5 — Payment terms

5.1 Individual clients (B2C)

Payment of the full price of the service is due on the day of the service, before it begins. The accepted means of payment are as follows:

  • Credit/debit card
  • Cash
  • Bank transfer

5.2 Business clients (B2B)

A deposit of 50% of the total amount including tax is due upon confirmation of the booking. The balance is settled on the day of the service or, subject to prior written agreement, within 30 days following the date the service is performed, upon presentation of an invoice.

The same means of payment are accepted. In the event of late payment beyond the agreed due date, late-payment penalties will be applied at the legal rate in force, together with a fixed recovery-cost indemnity of 40 euros in accordance with applicable law.

Article 6 — Pricing

The applicable rates are those in force on the day of booking, as indicated on the quotation accepted by the client. Signature Normandy Tours reserves the right to change its rates at any time, it being understood that services already confirmed will remain at the agreed price.

Prices are stated in euros, inclusive of all taxes (TTC) for individuals. For business clients, the applicable VAT will be specified on the invoice in accordance with the regulations in force.

Article 7 — Cancellation and modification

7.1 Cancellation by the client

Any cancellation request must be notified in writing to the Provider. The cancellation terms are as follows:

  • Cancellation up to 48 hours before the service: full refund of the amounts paid
  • Cancellation less than 48 hours before the service: no refund will be made; the full amount remains due

For business clients, the deposit paid is retained in the event of cancellation less than 48 hours before the service.

7.2 Cancellation by the Provider

Should Signature Normandy Tours cancel the service for reasons beyond its control (force majeure, illness, dangerous weather conditions, etc.), the Provider undertakes to inform the client as soon as possible and to offer either a rescheduling or a full refund of the amounts paid.

7.3 Modification of the service

Any modification requested by the client (date, itinerary, number of participants) must be made in writing and will be the subject of a new quotation if it results in a change to the price of the service.

Article 8 — Conditions of performance of the service

8.1 Professional status

Signature Normandy Tours operates as a Private Hire Vehicle with Driver (VTC) and holds the professional licence for the transport of persons. As such, the Provider declares that it complies with the professional regulations in force and assumes the duty of safety owed by any professional carrier towards the persons transported.

8.2 No-smoking policy

Signature Normandy Tours maintains a strict no-smoking policy in all of its vehicles, including electronic cigarettes. Failure to comply with this provision will result in the invoicing of cleaning and restoration costs at a fixed amount of €200 including tax.

8.3 Conduct in the vehicle

The consumption of alcohol is not permitted in the vehicles without the Provider's prior agreement. The driver is entitled to refuse to carry any passenger whose behaviour constitutes a threat to the safety of the driver, the vehicle or other passengers. The Highway Code requires passengers to wear their seatbelt. Failure to comply with this rule releases the Provider from liability in the event of an accident.

8.4 Vehicle capacity

The number of passengers carried may not exceed the maximum permitted by the vehicle's technical specifications. The driver reserves the right to refuse any additional passenger exceeding this limit.

8.5 Luggage

The total weight and volume of luggage are limited to the capacity of the vehicle used. The Provider reserves the right to refuse luggage or items exceeding this capacity or presenting a safety risk. Passengers' personal effects are under their sole responsibility. Signature Normandy Tours cannot be held liable for any loss of or damage to such effects during the service.

8.6 Animals

Small domestic animals (under 6 kg), suitably placed in an appropriate carrier, are accepted on board upon prior request at the time of booking. Assistance dogs are accepted without restriction. Any other animal is subject to the express agreement of the Provider.

8.7 Additional charges

Unless otherwise stated in the quotation, the following charges are not included in the price of the service and will be invoiced in addition according to the actual amounts incurred:

  • Motorway toll charges
  • Parking fees (stations, airports, sites visited)
  • Entry fees to sites (museums, châteaux, theatres, etc.)
  • Any other specific charge stated in the quotation

Article 9 — Delays

9.1 Driver delay

In the event of a driver delay, Signature Normandy Tours will contact the client as soon as possible to inform them and, if necessary, offer an alternative solution. In the absence of an alternative solution, the client may be refunded the amount of the booked service, up to a limit of €150 including tax.

9.2 Client delay — No-show

The driver is required to wait for the client for 15 minutes after the pick-up time set at the time of booking. After this period, a client not present at the meeting point is deemed absent ("no-show"). In this case, the service is considered to have been performed and its full amount remains due.

For pick-ups at airports and stations, an additional waiting period of 30 minutes is granted from the scheduled arrival time of the flight or train, to allow the client to collect their luggage and reach the vehicle. Beyond this, waiting charges may be invoiced under the conditions specified in the quotation.

9.3 Force majeure

Signature Normandy Tours cannot be held liable for delays caused by circumstances beyond its control: unforeseeable traffic conditions, accidents, diversions, weather conditions, strikes, air or rail delays. Such situations do not give rise to any compensation.

Article 10 — Damage

The client is responsible for any damage caused by themselves or by the passengers they accompany inside the vehicle during the service. The Provider reserves the right to invoice the client for any repair, cleaning or restoration necessary to return the vehicle to its original state of good working order, cleanliness and presentation.

Article 11 — Complaints

Any complaint relating to the amount of an invoice or to the conditions under which a service was performed must be sent in writing (by registered letter with acknowledgement of receipt or by email) to Signature Normandy Tours within 8 days following the date the relevant service was performed. After this period, no complaint can be taken into account.

Signature Normandy Tours cannot be held liable for items left behind in its vehicles or at the sites visited during the service.

Article 12 — Liability

Signature Normandy Tours holds a Professional Civil Liability insurance contract covering all of its transport and tour-guiding activities, including the financial consequences of bodily, material and immaterial damage likely to be caused in the course of performing its services.

The Provider's liability cannot be engaged in the event of:

  • Fault or negligence of the client or passengers
  • Unforeseeable circumstances or force majeure
  • Acts attributable to third parties

Article 13 — Obligations of the client

The client undertakes to:

  • Provide accurate and complete information at the time of booking
  • Respect the agreed timings
  • Behave respectfully towards the driver-guide and third parties
  • Comply with the rules and regulations of the places visited
  • Comply with the safety rules in the vehicle (seatbelt, no smoking, etc.)

In the event of inappropriate behaviour liable to disrupt the proper conduct of the service or compromise safety, Signature Normandy Tours reserves the right to terminate it without refund.

Article 14 — Languages of guiding

Guiding services are provided in French and English. The language of guiding is specified at the time of booking and stated on the quotation.

Article 15 — Protection of personal data

Personal data collected in connection with bookings (contact details, means of payment, travel-related information) are processed in accordance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679) and the French Data Protection Act No. 78-17 of 6 January 1978.

This data is used exclusively for the management of services and the client relationship. It is kept for a period of 3 years from the booking, then archived in accordance with the applicable legal and accounting obligations (5 years for the contractual limitation period, 10 years for invoices).

The client has at all times a right of access, rectification, erasure, restriction and portability of their data, as well as a right to object, by contacting the Provider in writing.

Article 16 — Intellectual property

The content, commentary, itineraries and materials produced by Signature Normandy Tours in connection with its services are the exclusive property of the Provider and may not be reproduced or used without prior written authorisation.

Article 17 — Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing an amicable agreement, the dispute will be submitted to the jurisdiction of the courts of Normandy (Caen or Rouen depending on the nature of the dispute).

For individual clients, in accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, the Provider offers a consumer mediation scheme. The client may use this mediation service free of charge in the event of an unresolved dispute.

Article 18 — Amendment of the Terms

Signature Normandy Tours reserves the right to amend these Terms at any time. The new conditions will apply to any booking made after they are published online or communicated to the client.
